(- <br />(Page 21 • <br />MINE ID rY OR PROSPECTING ID N M-87-002 <br />INSPECTION DATE 11/13/96 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection by the Division was performed as part of its monitoring of 110 permits. The operator was contacted about the <br />inspection and was able to be present for it. The required permit ID sign and boundary markers were observed. <br />There is no excavation currently being carried out. There will be no further excavation at this permit area, and until the remaining <br />several thousand yards of stockpiled gravel is gone, reclamation will not commence. The site consists of a level bench and a steep <br />highwall. The edge of the bench adjacent to the wet meadow marks the permit boundary. The top of the highwall is near the permit <br />boundary, and is unstable. Portions of the permit boundary (being marked by a fenceline at those locations) above the highwall are <br />visible from below. Even though the highwall's slope gradient meets the specification contained in the approved reclamation plan, <br />it is now seen to be unstable and will be made gentler. <br />This aspect of the reclamation, addressing the steep highwall and its close proximity to the boundary, was discussed during the <br />inspection. The operator recognizes that the slope is too steep to remain stable or be successfully revegetated. Too much material <br />was excavated and removed from the permit area to allow the slope gradient to be reduced by backfilling from onsite material from <br />the bench. He proposed to introduce material from above. Part of this material would originate from an offsite source, specifically <br />from the berm of native bank material found in the highway right-of-way. <br />The operator realizes that the slope specified in the permit's approved reclamation plan is somewhat incompatible with the <br />reclamation standard contained in the Construction Materials Rules: the approved plan's slope gradient has been met, though the <br />hillside is not stable; the Rules specifies that geotechnical stability will be achieved. The approved plan also does not require any <br />revegetation. The operator has apparently opted to reclaim and stabilize the site to a standard beyond that contained in the plan, <br />e.g., reduce the slope to an angle that will hold soil and moisture, and allow vegetation to become established. Accomplishing this <br />will require placing material on the slope, especially at the base. <br />In order to introduce material for reclamation, which was generated from offsite sources, the operator must furnish the Division a <br />notice containing information as to its nature, volume, source, etc. The notice is fully explained in Rule 3.1 .5191. If the right-of-way <br />material is used as discussed, it will be accepted as generally inert. The operator will have to secure agreements for taking such <br />material from the r.o.w from the Colorado Dept of Transportation, and for the resetting of the overhead powerline poles from the <br />REA in Gunnison. The details of those agreements are outside the jurisdiction of this Division, but copies of the agreements would <br />be useful for purposes of this Division monitoring the overall reclamation scheme, timeframe, etc. <br />If the operator intends to subsequently introduce any material to be used for growth medium or enhance [he fertility of the site, the <br />same type of notice required by Rule 3.1.5(91 must be submitted. <br />There was a small amount of broken concrete rubble noted at the toe of the highwall slope. This material could be used as part of <br />the backfill, it it will be placed above the water table. The operator stated that it would be removed and disposed of elsewhere. <br />This temporary placement onsite is not a problem. <br />There were no other items discussed or observed during the inspection, or problems noted during this inspection.
