III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Processing Waste Icont'd) <br />There was minor puddling at the west end of the initial disposal cell. Waste material within the cell has <br />been spread and graded, and the bottom of the cell is covered by a thin layer of graded refuse. Operator <br />indicated that the lift thickness remained less than two feet thick, and that additional material would be <br />spread, graded, and compacted, before initial compaction testing is conducted. Design requirements <br />specify that the pile be constructed with compacted layers not to exceed two feet thick. <br />Two of the three recently approved sediment disposal cells have been constructed on the top of the <br />refuse area non-toxic cover stockpile, and have largely been filled with sediment from the previous pond <br />cleaning event. The third disposal cell will need to be excavated and used for disposal of sediment pond <br />cleanings necessitated by the September 9 storm event. <br />Revegetation <br />Various locations will need to be seeded with the approved interim seedmix this fall, including the surficial <br />slide repair area at the portal bench, and areas disturbed in association with sediment clean-out and <br />disposal, pond berm construction and spillway modification in the vicinity of the refuse disposal area. <br />The small patch of Russian knapweed adjacent to the upper access road in one location was cut or pulled <br />earlier this summer to prevent seed formation. New growth should be sprayed this month. A small patch <br />of Canada thistle located on the access road cut slope in one location should also be sprayed this month. <br />Contact Jude Sirota, Mesa County Weed Manager (970-255-7120), or Steve Anthony, Garfield County <br />Weed Manager (970-625-8601), for recommended treatment approaches, application rates and timing, <br />etc. <br />There has been generally good establishment on areas of the mine bench and waste disposal area seeded <br />with the interim seedmix. Unfortunately, areas in the vicinity of the waste disposal area sediment pond <br />and the cover soil stockpile have been re-disturbed and will need to be seeded again this fall. <br />6 <br />
