llI. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. "Che comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Jim Kiger represented the <br />operator during the inspection. There was no activity on site. There has been a lot of rain in the past two weeks. <br />Hydrology <br />The east sediment pond had a fair amount of standing water in it, about one foot below the invert of the primary <br />discharge pipe. The gated valve was closed. The pond emergency spillway was functional. The pond inslopes <br />were stable and the pond embankment was well vegetated. <br />The west side dugout pond was dry. "1'he spillway had sufficient capacity and the riprap was in place. <br />The loadout ditches were functional. The railroad small area exemption straw bales and silt fence also were in <br />place. 't'here were no problems with the private irrigation ditch on the west side of the loadout area. No water <br />was flowing in the ditch. <br />1'opsod Stockpiles <br />The west topsoil stockpile was well vegetated. The topsoil sign was up. The collection/diversion berm was in <br />place. The east topsoil stockpile had a moderate amount of vegetative cover. 'the collection and drverswn <br />ditches were well vegetated and had capacity. The topsoil signs were up. <br />eacurties <br />There were no problems noted at the mine office and shop area, the substation, weigh station and loading <br />-. <br />tacilrt~es. there were no fuel leaks at [he tuel taciltty. Uunng the Leltl inspection, there were no railcars being <br />loaded, nor were there any coal haul trucks being unloaded. Only a very small volume of coal was being <br />stockpiled on the facilities bench. No problems with fugitive dust were observed. <br />Roads <br />The main paved haul road was in good condition. The guard rail was in place. The east side graveled road was <br />in good condition as well. The east side gate was open. The light use road along the tracks was muddy but <br />passable. <br />Siens and Markers <br />The mine ID sign was up at the main entrance. The information on the sign was correct <br />c:/word/terror/insp 1006 <br /> <br />
