COMMENTS - COMPLIANGE <br />8e1ow are comments on the inspection. The comments include discussion of observaUOns made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground mine is reclaimed. Remaining buildings <br />and structures are approved to remain as permanent structures. The weather was clear and <br />cool and ground conditions were generally dry. <br />Availability of Records <br />The public copy of the mine records is kept at the office of the Las Animas County Clerk and <br />Recorder. Many of the records are not current including quarterly pond inspections, <br />reclamation report, hydrology report. DMG inspection reports, and 2003 water monitoring <br />records. The latest approved 5-year permit and associated findings document are also not <br />on file. The liability insurance certificate was found current but will expire October 1, 2003. <br />The results of the records inspection can be found on page 2a of this report. Please ensure <br />records are current through the 2i° quarter of 2003 by the next DMG inspection in October. <br />Hydrologic Balance <br />The sediment pond held water three inches below the top of the discharge riser. The pond <br />was not discharging, however, there was evidence that the water had risen to about four <br />inches above the top of the riser in the recent past, likely due to persistent storm events. The <br />pond embankment and the emergency spillway appeared normal and in good condition. <br />The contour ditches recently installed along the refuse slope have been repaired and <br />appeared in good condition. The 100-year clean water diversion ditch was found on good <br />condition along its entire length. <br />
