<br />OBSERVATIONS
<br />This inspection of the O'Bannon Pit occurred in response to citizen complaint. Written complaint,
<br />dated 6/9/98, was submitted on 6/12/98, and signed by the following individuals:

<br />The written complaint was general in nature and did not identify specific concerns or issues. On
<br />6/17/98, DMG responded to the complaints with a request for identification of specific issues.
<br />DMG has not received response from the complaints to DMG 6/17/98 request.
<br />Location: The O'Bannon Pit is located approximately 7 miles east of South Fork, and
<br />approximately 1 mile north of the intersection of Hwy 160 and County Road 18, in portions of the
<br />SW 1/4 of the NE 1/4 of Section 27, T40N, R4E, NMPM, Rio Grande County.
<br />Records: The O'Bannon Pit is a phased 112 type reclamation permit. The permit is approved for
<br />the surface extraction and processing of construction materials, 26.4 acres affected area.
<br />Permittee and operator is Mathias Concrete, Inc. DMG holds 519,400 financial warranty.
<br />The original permit was issued on 10/23/80 to Colorado Division of Highways for 9.93 acres
<br />affected area. On 1 /4/84, DMG approved transfer of permit ISO-01) for Douglas O'Bannon as
<br />successor operator. On 6/9/89, DMG approved transfer of permit (SO-02) for Mathias Concrete
<br />as successor operator. On 6/19/92, DMG approved a permit conversion (CN-01-, affected area
<br />was increased to the current 26.4 acre area. DMG records do not indicate additional revisions to
<br />the permit.
<br />Signs & Markers: Mine identification sign was posted at the mine entrance. Perimeter of
<br />affected area was sufficiently delineated. Mining activities were contained within approved areas.
<br />Public access to the permit area is controlled by locked gate and fencing. Mine access road was
<br />well maintained.
<br />Mine & Reclamation Plans: Mining activities appeared to have been conducted in accordance
<br />with the approved Mine Plan. Reclamation of the mined areas appeared current. Status of
<br />permitted acreage was visually estimated as follows:
<br />Approximately 3 acres reclaimed along the north and NW end of the permit area.
<br />Reclamation backfilling, grading, topsoil replacement and seeding appeared near
<br />completion. Pit inslopes had been backfilled and graded to the approved 3H:1 V slope,
<br />topsoil replacement and application of mulch were evident. Vegetative cover was
<br />established and included several varieties of wheatgrass, Indian ricegrass, Smooth
<br />brome, Rubber rabbitbush, several varieties of clover, sage, Downy brome, Kocha,
