f. • • <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone 1970) 247-5469. Operations were active during the time of this <br />inspection. Tom Bird was not available to accompany the DMG inspector. <br />Signs & Markers -Mine identification sign and safety signs were posted at the mine <br />entrance. Permit boundary markers were observed. Public access is controlled by gate <br />and fence, gate was open. <br />Roads -Mine entrance road and access roads were well maintained. Mine entrance <br />road drainage conveyance Swale was intact. <br />Hydrologic Balance -Affected area drainage was conveyed to one of the two sediment <br />ponds for treatment. Sediment containment ditches and culverts appeared clear of <br />debris/sediment, functional and stable. <br />Large sediment pond was holding water approximately <0.5' depth. Sediment clean- <br />out had recently occurred. Primary and secondary spillways appeared stable and clear <br />of debris, debris screen was intact for the primary spillway. No discharge noted. An <br />overflow pipe had been installed to convey overflow from the large sediment pond to <br />the smaller sediment pond. Overflow pipe was a 0.6' diameter PVC, vertical riser <br />intact, debris screen absent. Pond embankment appeared stable, evidence of seeping, <br />slumping, or erosion was not observed. <br />Small sediment pond was dry, no discharge noted. Primary and secondary spillways <br />appeared stable and clear of debris. Embankment was well vegetated and stable. <br />Fuel/Fluids Storage -Spill containment berm was intact for the fuel storage tank <br />located adjacent to coal bins. Evidence of minor fuel spills, contained within the <br />bermed area, was observed. Evidence of tank rupture or leakage was not observed, <br />tank appeared intact. Fire extinguisher and safety sign were posted at the fuel tank. <br />Spill containment berm was intact for lubricant storage rack. Seven 55-gallon drums <br />were mounted on the rack. Empty drums were stockpiled and awaiting removal. <br />Coal Refuse Pile -Refuse pile sign, ID # 1211-CO-09-00266-1, was posted. <br />Reconfiguration of the refuse pile appeared near completion. Upland diversion ditch <br />was intact, minor ditch improvements for steep slope segments remain to be <br />completed. Surface of the refuse pile had been graded to provide positive drainage, <br />front slope had been graded to approximate 2.5H:1 V slope and covered with soil layer. <br />
