1
•
•
:I. Compliance ~rt.i Colorado Surface Cca: :Sin.ng Reclamation .act
/ ` CRS i47J, as amended 39-3J-10', _t. sec.,
a.:d the
A.u'es and Recv_'a~ons Issued 2ursuant to ~5e Act
G
?his includes a listing of the oartic:lar provisicns o: tie regu_atory procram which were
examined dur.'ng the course of t::is inscection, and identifies enforcement actions taken
during t::e inspection for failure to comply with the Rules and Regu_'a tons, tie Act and
the permit.
Rule 4.03 Roads
The culvert between the entrance gate and the first switchback was inspected. The inlet
end is clear. The outlet end has not been repaired. The operator plans to replace a
short section of the culvert on fhe outlet end.
It did not appear that any additional road work or down slope spoiling has occured at
the road Leading to the south fan.
Rule 9.05 llydrologic Balance
Riprap has been placed at the outlet end of the stockpile pond dewatering device and in
the ditch leading to the pond.
.The dewatering device in the large pond was free of debris. Pond ;12 had a fair amount
of water ~in it. A thick layer of ice is on top of the water and no water was being
discharged.
The large diversion ditch above the mine bench and portals is nearing completion.
Currently the southern end drains toward the south. According ~o mine maps the entire
ditch is to drain towards the north. If the maps are correct then some additional yrading
and placement of material will be required to insure that the ditch drains properly.
The 10" cmp that will pick up drainage from the upper diversion ditch and the bench has not
been installed yet.
The operator's engineer has done some drilling on the mine bench to explore the possibility
of installing a french drain through the bench in order to prevent and decrease bench
instability due to water erosion.and saturation.
The berm along the outside edge of the bench needs to be strengthened in a Few places.
The berm is low enough in a few spots as to allow water or other bench material to leave
the bench. Coal should not be stockpiled so near the bench edge that it spills down the
outslope. Also material that has been scraped up from the bench during snow removal
should not be pushed or piled near the bench edge. This material spills down the outslope
and/or contributes to the water saturation and runoff problem that already exists at the
bench edge.
