III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />dunng the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of Minerals <br />and Geology on December 17. 2003. Kent Gorham of the CDMG reviewed 17 digital oblique <br />aerial photographs in the office on January 12, 2004. This coal operation is currently under a <br />temporary shutdown due to market conditions. Permit Renewal (RN-01) became final on <br />December 21, 2003 and was approved with stipulations for reclamation only <br />Hydrologic Balance <br />Snow covered much of the ground on this day, especially in north-facing or shaded areas. <br />Pond 9 was clearly visible in two of the photos and appeared frozen and snow-covered. The <br />embankment appeared normal. Pond 8 was snow-covered but appeared dry. The <br />embankment and spillway appeared normal and functional. A remarkable. clear image of <br />pond 5 indicated a frozen body of water held in the pond. The embankment and emergency <br />spillway were clearly visible and the pond appeared in excellent condition. Ponds 6 and 7 <br />were also visible and although snow-covered. were noted as dry. Ditches D96 and D99 were <br />clearly visible and appeared in good condition with no evidence of breaching or damage of <br />any kind <br />,.#... ; <br />r ~' ~ ~~ <br />I ,y ~J.Y ~ IY <br />.~ .+ <br />- ~ ` ~ J <br />Pond 5 <br />Backfilling and Grading <br />Backfilling of highwall areas appears complete. No exposed highwalls were visible in any of <br />the disturbed area. Slopes blended well with the tops of highwalls and evidence of slumping, <br />erosion or damage was noted in any of the photos. Some grading was evident on the lower <br />portion of Fill 8 but appeared to be related to topsoiling activities. <br />Support Facilities <br />Four coal stockpiles and a portable coal crusher were noted in a photo taken of the coal <br />loadout area at the mouth of Lorencito Canyon. An estimated 5000 cubic yards of coal <br />remains at the coal loadout. The mine is currently discussing a suitable location for disposal <br />of this coal, possibly in the pit area. <br />
