III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the Terror <br />Creek Company during the inspection. There had been some precipitation over the weekend. <br />Hvdroloey <br />The sediment control system was functioning properly. Culverts were clear and the ditches had sufficient <br />capacity. There was a little standing water in the east side sediment pond. The gated primary pipe valve was in <br />the closed position. The pond embankment and pond inslopes were well vegetated. The west side sediment pond <br />was dry. At the railroad track small area exemption, the straw bales and silt fence were in position. <br />Topsoil Stockpiles <br />The west side and east side topsoil stockpiles had good vegetative cover. Collection and diversion ditches were <br />vegetated and had sufficient capacity. The topsoil signs were up. <br />Facilities <br />No problems were observed at the loadout office, shop, electrical substation, coal handling structures or at the <br />material storage area. There were no fuel leaks at the fuel facility. The berm on the outside edge of the facilities <br />bench was of a sufficient height. During the inspection, several coal haul trucks unloaded. No rail cars were <br />being loaded but several loaded rail cars were on site. There were only four small coal stockpiles on the facilities <br />bench. There were no indications of any fugitive dust going offsite. No coal dust was being tracked onto the <br />highway. <br />Roads <br />The paved main haul road was in good condition. The guard rail was in place. The graveled road on the east side <br />of the loadout was also in good condition. The east side gate was open. The light use road along the railroad <br />tracks was passable. <br />Signs and Markers <br />The mine ID signs were up at the main entrance, east gate and along the road near the railroad tracks.
