III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. <br />Facilities <br />In the last inspection report, mention was made of a small break in the berm along the outside edge of <br />the facilities bench. As it turns out, there is no problem with this break since surface runoff Flowing <br />through this break in the berm goes into a small sump area. The water is, then, pumped back up onto <br />the facilities bench. <br />There were no problems with any of the facilities. There was some repair work being done during the <br />inspection so no rail cars were being loaded. The Union Pacific Railroad is replacing selected track ties <br />in the area so there were only a few rail cars on site. No leaks were evident at the fuel facility and no <br />problems were noted at the material storage area and at the office/warehouse area. <br />Hvdrology <br />There was only a little standing water in the sediment pond. The gated valve was closed. Pond inslopes <br />were well vegetated. The pond embankment was also well vegetated and appeared to be stable. The <br />west pond has been cleaned out and the small hill slide near the pond was repaired. <br />The operator has cleaned out the drainage ditches at the loadout side. The silt fence and straw bales at <br />the railroad small area exemption were in place. However, the silt fence on the far west end of the track <br />siding will need replacing soon. <br />Topsoil Stockpiles <br />Both topsoil stockpiles had good vegetative cover. Topsoil signs were up and the collection and <br />diversion berms were functional. <br />Roads <br />The paved haul road was in very good condition, as was the graveled east access road. The east gate <br />was open. The light use road along the railroad tracks was dry and passable. There was no coal dust on <br />the main highway. <br />cJword/terror/insp0705 <br />
