~G <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals <br />and Geology. Basil Beaz represented the operator for the records inspection. No one represented <br />the operator during the field inspection. It had snowed the day before. Most of the main mine <br />site and the West Portal were covered in snow. Most of the train loadout was cleaz of snow. <br />Roads <br />The snow on the paved haul road had been graded and melted off later in the day. The access <br />road leading from the crusting and screening bench to the portal bench was partially covered in <br />snow, but had been graded. Light use roads were covered in snow and were not graded. The <br />roads appeazed to be in good shape. <br />Signs and Markers <br />Mine ID signs were present. Topsoil stockpile signs were also up. <br />HXdrology <br />The ice level in the West Ridge waste pile pond was 1 foot below the weep holes. The ice and <br />snow level in ponds 1 and 2 were 3 feet below the primary top and 4 Feet below the primary top <br />in ponds 3 and 4. The West Portal pond and the ROM pile pond had ice and snow within 2 feet <br />of the primary dischazge level. There was water in the highway coal stockpile pond, to within 5 <br />feet of the top of the pond. The loadout pond was dry. All pond embankments appeazed to be <br />stable. All spillways appeared to be functional. <br />Most of the culverts and ditches were covered in snow. Silt fences were up, as were straw bales, <br />at the small area exemption locations. Most of these azeas also were covered in snow. No <br />erosional problems were observed. <br />Facilities <br />No problems were observed with any of the facilities at the main mine site, West Portal bench <br />and water tank and fan bench, well field area and the loadout. No fuels or antifreeze were being <br />stored at the main mine portal bench. Coal was still being stored on the crushing and screening <br />bench, although the operator is shipping some quantities out. No smoldering coal was seen. <br />
