III. COMMENTS COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. Weather on this day was warm and humid. <br />Signs and Markers <br />The mine identification signs should be revised to indicate the correct address <br />and phone number for Lorencito Coal Company. The current sign reflects the old <br />Bentwood address in Evanston, Indiana. <br />Hydrologic Balance <br />Lorencito creek was flowing and appeared cloudy, likely due to recent rams. <br />Evidence of recent flow was noted in normally dry gullies and arroyos. <br />Thunderstorm activity due to a monsoon weather pattern was noted on the previous <br />afternoon. <br />Ground water well cluster MW-5 in Alamosa Canyon was visited. Some thistle plants <br />were mechanically removed at this site. Well cluster MW-6 in Bonita Canyon was <br />visited. Well MW-6I was bailed. Bubbles were noted in the water in the bailer. <br />An operational gas well is immediately west of this site. The other two wells at <br />this site were found capped and locked. Well cluster MW-4 was also visited. Well <br />MW-4I was bailed and bubbles were noted in the water sample. An operational qas <br />well is located some 500 feet east of this site. All wells at this site were <br />found capped and not locked. <br />General Mine Plan Compliance <br />The mine has yet to commence operations at this time. Permit Revison No. 1 (PR- <br />O D is currently under review. The permit has been extended to May 10. 2002 for <br />commencement of operations. <br />Cultural resource site 5LA7194 was visited. This site would not appear to be in <br />jeopardy of disturbance given the proposed plan under PR-O1. Approximately 280 <br />feet east of this cultural site. evidence of a linear disturbance running in a NE- <br />SW direction was noted. This appears to be a pipeline based on map 2.04.3 la <br />submitted with PR-O1. This line would be impacted by construction of Pond 7-4 and <br />Fill 7-2, as proposed under PR-O1. The operator should consider this pipeline in <br />the mine plan. <br />No coal mining activity was noted under this permit. <br />3 <br />
