III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of CDMG. The Grassy Gap mine is a reclaimed surface <br />mine. The mine permit and reclamation liability bond have been revoked by DMG. <br />Siens & Markers : DMG informational signs remains at intersection between Pit 2/3 road and Pit S/6 road and <br />along the Pit 4 road, Main entrance gate at Routt County Road No. 27 was locked. Janet left word with the <br />property owners, Cross Mountain Ranch, that I would be on the property. <br />Hvdrol~ic Balance; Pit 5 spoil spring flow is reduced to a trickle. The Pit 5 spring pool is stagnant. Pond 5 <br />was barely discharging. The springs alongside Pit 4 access road were dry. Pond 4 was holding a small pool of <br />water several feet below the outlet elevation. Grassy Creek is flowing. Springs along access road to Pit S/6 were <br />flowing at a low rate. Natural springs along access road to Pits 2/3 were flowing too. <br />Reveeetation: Pit 4 vegetation was in good condition. However, roughly 3S cow calf pairs were grazing on the <br />reclaimed Pit 4. At the time of the inspection the grazing had been minimal. Vegetation in Pits 5 and 6 are in <br />good condition. Cross Mountain Ranch, the surface landowner, has not used the property in their grazing <br />rotation yet in 2004. <br />The access road to Pits 2/3 was drivable all the way to the reclaimed pits. Pits 2 & 3 vegetative cover was good. <br />Livestock grazing has not occurred in pits 2/3 yet this season. The access road to Pit 1 could be driven all the <br />way to the pit, though the inspector drove part of the way and walked half of the road to determine the condition <br />of the road. Vegetation in Pit 1 was good with no livestock grazing having occurred yet this season. <br />The Division is planning to sample the reclaimed areas vegetation in July 2005 for reclamation success <br />determination. Sampling dates and the need to keep livestock off the site until sampling is completed has been <br />communicated to the landowner, Cross Mountain Ranch. <br />One patch of Whitetop was observed along the ditch between pit 5 and 6. This patch was sprayed once before by <br />the Division, Patch is limited in area to approximately 1 S R. by 20 ft. <br />Slides: No new slides were noted. The old slide to the west of pond 4 is healing and is almost hidden by <br />vegetation. No new gullies or erosional features were noted. <br />Wildlife: One Bull elk observed along Grassy Creek between the pits. A cow elk was noted at the South end of <br />Pit S. <br />The inspector collected GPS data during the inspection to use during the vegetation sampling efforts in July <br />2005. <br />
