[II. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jce Dudash of the Colorado DMG. No one represented the operator <br />during the field inspection. There was no snow on the ground at the loadout. <br />Signs and Markers <br />Mine ID signs were up at the main entrance, east side entrance and near the railroad tracks on the east side. <br />Perimeter markers were up along the permit boundary. <br />Roads <br />The paced haul road was in good condition. The graveled east side access road was also in good condition. The <br />east gate was open. The tight use road along the railroad tracks was a little muddy but was passable. <br />Facilities <br />No problems were noted at the shop and office area, material storage azea and the loading structures. There were <br />no leaks or other problems at the fuel facility. There were only a few small coal stockpiles on the facilities bench <br />and only one coal haul truck was observed unloading during the field inspection No railcars were being loaded. <br />There were no indications of fugitive dust offsite. <br />)~drology <br />The east sediment pond had a little water in it. The west dugout pond was dry. The spillways of both ponds were <br />functional. The east pond embankment was well vegetated and appeared to be stable. Pond inslopes were stable <br />as well. The straw bales and silt fence along the railroad small area exemption were in place. <br />Topsoil Stockpiles <br />Both topsoil stockpiles had good vegetative cover. There were no signs of obvious erosion. Collection and <br />diversion ditches were well vegetated and had sufficient capacity. Topsoil signs were up. <br />c:/word/tenor/insp0306 <br />
