Mr. Paul McGehee of United Construction Company met me at the United/Norwood Pit. We discussed <br />the fact that the Permit Amendment has been approved with three stipulations. Mr. McGehee indicated that the <br />Financial Warranty has been submitted and stands at $179,000.00 for Phases [through III, encompassing 44.2 <br />acres (Stipulation Number 1). Stipulation number 2, requiring documentation proving legal right to enter and <br />initiate mining on the affected land, has not yet been fulfilled. The operator has provided the Division with a <br />statement that all permits, required by other applicable laws have been applied for (Stipulation Number 3). <br />Mining has not commenced on the amended permit area. <br />2. An entrance sign to the mine was posted; boundary mazkers were posted at the Phase I corners, but were <br />difficult to see. Please note Rule 3.1.12.(2) which states that the boundaries of the affected azea will be marked <br />by monuments or other markers that are clearly visible and adequate to delineate such boundaries. <br />Please install additional markers around the outer perimeter of the affected area for which financial warranty has <br />been posted, i.e., Phases I, II and III, such that they are clearly visible by May 27, 1997. <br />3. Numerous partially filled barrels, fuel storage tanks and other containers of undetermined substances <br />were scattered on the ground around the perimeter of Phase I and within Phase V of the permitted area. <br />Hazardous materials such as fuel, oil, hydraulic fluid, antifreeze, batteries and waste oil must be stored in an <br />impermeable containment structure adequate to contain, at a minimum, the volume of the containers stored <br />within the structure. Empty containers should be adequately disposed of. <br />Please contact this Office by May 27, ] 997 regarding your plans for adequate disposal or construction of <br />containment facilities for these materials. <br />4. The western slope of Phase I was graded to 3H:1 V or less and topsoil was being placed thereon. <br />5. Phase V of the operation is currently used for Skelton Construction Company's truck and equipment <br />storage yard. This area apparently has gravel placed directly on top of topsoil. Mr. McGehee indicated that the <br />topsoil will be salvaged prior to mining this area. Barrels, fuel tanks and other containers were located in this <br />area.
