(Page 2) <br />MINE ID # OR PROSPECTING ID # M- 1980-135 <br />INSPECTION DATE 12/10/03 <br />OBBBRVATION3 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS GRS <br />This was an inspection of the Headley Farms Permit area conducted by Gregg Squire of the <br />Division of Minerals and Geology. The manager of the Pinneo Feedlot, Joel Chisum, <br />accompanied the inspector. This permit has been held by several different operators, at this <br />time Western Cleanup Corporation still holds the permit, but has sold the property to Pinneo <br />Feedlot. The Division has received a Succession of Operators Application Form to transfer <br />the permit to Pinneo Feedlot, but the succession has not yet been approved by the Division. <br />Weather conditions on site were clear and cool, with a few inches of snow on the ground. A <br />permit sign is posted at the entrance to the pit. It should be noted that upon approval of <br />the Succession of Operator, the Permit ID sign must be modified to show the new operator. <br />The 112c Mining and Reclamation Permit was issued to mine 59 acres. There is no active <br />mining taking place at this time, but there are numerous stockpiles of topsoil, overburden <br />and mined material at various locations within the permit area. As noted in the Division's <br />March 15, 1999 inspection report, Pits 2 and 3 contain water. That report also stated that <br />" Upon further review of the file, there appears to be no information regarding groundwater <br />rights." On April 29, 1999 the Permit Holder, The Farmers State Bank of Brush, provided the <br />Division with a District Water Court Decree (Water Division No. 1, Case Non. 90-CW-189), <br />which appears to satisfy the augmentation question. <br />The Division report of March 15, 1999 also stated that "Gravel pit #4 was not inspected due <br />to access. The pit is located west of County Road 31. Al Campbell (Representing Farmers <br />Bank of Brush) stated that the property west of County Road #31 is not owned by Farmers Bank <br />of Brush, and the status of the pit was unclear." In the April 29, 1999 response from the <br />bank it was stated that "In regard to Gravel Pit #4, the pit has been generally reclaimed, <br />but we wish to continue the mining and reclamation responsibility for the present time." The <br />Division is requesting that the new operator, Pinneo Feedlot, inform the Division of the <br />current status of the Pit #4 area, including the land ownership, the current situation as far <br />as reclamation goes, their plans for this area, and what the legal right of access is. This <br />should be done by March 31, 2004. <br />It was noted that there was some broken concrete stored on the site. If the operator plans to <br />use this material as backfill, they must provide the Division notice of the proposed backfill <br />activity as described in Rule 3.1.5(9). A copy of this Rule is enclosed. <br />During the inspection no permit boundary markers were observed. These markers must be put in <br />place to locate each of the pit boundaries, including Pit #4. To assist the operator in <br />locating these boundaries the Division is enclosing the following documents: <br />1) A map sent to the Division by the Farmers State Bank, received on October 7, 1985, <br />which shows the location of Pit #4. <br />2) A map sent to the Division by the Farmers State Bank, received on September 6, 1990, <br />which shows areas added and deleted by a Technical Revision approved in 1990. <br />3) A map submitted by Western Clean Up Corporation as part of their September 16, 2003 <br />Annual Report, which appears to be a slightly modified version of the September 6, 1990 <br />map. <br />The Division plans to inspect this site as part of the Succession of Operator process to <br />reevaluate the financial warranty. The operator should notify the Division when the <br />boundary markers are in place, and an inspection date will be set. In any case, the latest <br />that the markers must be placed is no later than March 31, 2004. <br />
