ORIGINAL-PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-~nn~-nR5 <br />INSPECTION DATE: ~/~8/07 <br />OBSERVATIONS <br />The Division conducted a pre-operational inspection of <br />the inspection were Frank Leone, the operator and Joe <br />prepared the application. <br />INSPECTOROS INITIALS: -S~ <br />the site on 2/28/07. Present during <br />Gagliano, the consultant who <br />1) Site is located approximately 6 miles east of Trinidad Colorado. <br />2) Approximately 190 acres are being proposed to be mined in 20 acre phases of maximum <br />disturbance at any given time under the proposed application. <br />3) Permit application sign properly, posted at the access to the proposed operation. <br />4) Entire permit area driven and inspected. Permit boundary markers properly posted. <br />5) Permanent man made structures were as identified in the application. Operator will <br />still need a notarized letter of agreement with the gas line owners noted with in <br />the proposed affected area. Operator said the letter will be provided once the <br />adequacy letter is sent after end of comment perion3/14/07. <br />6) There are what appeared to be small created drainages that feed the main drainage <br />along the East side of the proposed area. Mr. Leone stated that the Army Corps of <br />engineer with the consent of the land owner had suggested that these created <br />deranges be back filled with overburden, during the mining operation phase. <br />7) Operator plans to construct a concrete crossing over the main drainage, which will <br />be left as a permanent structure and will not be included in the financial warranty <br />for the site. <br />8) There were a few stock ponds that were noted along with some dead carcasses (cattle) <br />as result of the recent snow storm with in the permit area. <br />The site was as described in the permit application. <br />I & E Contact Address <br />NAME: JOE GAGLIANO <br />OPERATOR: LJ DEVELOPMENT INC <br />STREET: ~51~ N MFRRII I I~RIVF <br />CITY/STATE/ZIP: PIIFRI t7 WEST.
