BANTA, Director <br />January 14, 1988 <br />Mr. John Schmahl <br />Mesa Rock Company <br />2301 River Road <br />Grand Junction, CO 81501 <br />Re: Surface Rock Pit (File M-84-001) <br />Dear Mr. Schmahl: <br />The Division has recently conducted a review of the Surface Rock Pi Mining <br />and Reclamation Permit (M-84-001). This review indicates that ter in issues, <br />which were addressed by the Division during the spring of 1987, rem in <br />unresolved at this time. <br />To briefly summarize the site history, the Division received an app ication <br />fora mining and reclamation permit on January 3, 1984. The Mined and <br />Reclamation Board approved the permit application on March 23, 1984 The <br />approved permit area totals 90 acres, 59.5 acres may be disturbed b mining <br />operations. Of the 59.5 acres to be disturbed by mining, only 7.5 cres (4 <br />acres in Parcel A, 3.5 acres in Parcel B) may be in a state of majo <br />disturbance at arty one point in time. In addition, only 10 acres ( acres in <br />Parcel A, 4 acres in Parcel B) may be in a state of moderate distur ante at <br />any one point in time. <br />A financial warranty in the amount of X13,000.00 was accepted by th Division <br />on April 4, 1984. The amount of the warranty was based upon the p jetted <br />maximum allowable site disturbances, as outlined above. <br />On April 9, 1987, the D1vlsion conducted an inspection of the Surfa a Rock Pit <br />operation. The inspection revealed that the operation may not be i <br />compliance with numerous aspects of the approved permit, as well as portions <br />of the Colorado Mined Land Reclamation Act. A copy of the inspecti n report <br />is attached for your review. The operator was urged at that time t submit a <br />permit amendment by May 31, 1987, to address the problems noted dur ng the <br />site inspection. <br />On June 1, 1987, the Division received a response to the inspection concerns <br />from your attorney. The response included a revised Operation Plan and Final <br />Development Plan maps, as well as a brief response to each inspecti n <br />concern.
