<br />INSPECTION REPORT - PAGE 2 <br />FILE N0. 83-33 <br />DATE: September 11, 1984 <br />OBSERVATIONS OF IMPORTANCE: <br />On September 11, 1984, Jim McArdle and I observed mining operations on the <br />south side of Clear Creek on the opposite bank from the Walstrum Mine scale <br />house. These operations were attributed to Al Frei's operation by Mr. <br />Briddle, an employee of Al Frei, and Mr. Hardin, an adjacent operator. Mr. <br />Briddle stated that the fill operations occurred three weeks prior to the <br />inspection. <br />These mining activities are outside of the Walstrum Mine permit area and <br />therefore constitute a possible violation. <br />The mining activities observed are as follows: <br />1. A road fill approximately 15 feet wide by 1000 feet long was <br />constructed adjacent to Clear Creek; <br />2. The fill was constructed of fine material originated from the <br />Walstrum Mine; and <br />3. Gravel processing equipment was being stored in a one acre leveled <br />area on the fill. <br />Damage to the environment from the fill construction included: <br />1. Filling the flood plain area thus constricting the flow of Clear <br />Creek during flood stage; <br />2. Covering the riparian habitat adjacent to Clear Creek; and <br />3. Nonremoval of topsoil and trees from the disturbed area prior to <br />construction of the fill. <br />RECOMMENDATIONS: <br />1. Amend the permit incorporating all areas of disturbance. Since this is <br />additional acreage with new adjacent landowners, an amendment will be <br />necessary. <br />2. The amendment must address remedial measures regarding the existing <br />damages to the environment. <br />CR/db <br />Doc. No. 4154E <br />
