Wakher
Executive Direcbr
nudael e. t~
Division Diretlar
I have received your February 27, 2002, letter regarding the above-named site. In the letter you outline the
corrective actions to be performed for the outstanding problems and issues at the site. I have the following
comments about these items.
Some of the issues aze classified as problems (under the 10/19/2001 inspection) and required that responses be
performed or submitted by specified dates. These issues were the construction of the 9700 level drainage bypass,
rehabilitation and erosion control of the road to the lower tailings pond, and more effective noxious weed control.
Your letter included a request for an extension of time for correcting each of these three issues. The dates you
propose for correction of these problems are reasonable, and are approved.
However, please note that your request was submitted after all three of the original correction dates had passed. We
must both put these three new dates on our calendars, and ensure the timely submittal of the required materials and
performance of the required activities. If it appears that the corrective actions will not be completed bathe
extended dates, please contact me before those dates to discuss the progress and a possible extension.
The other issues in your letter, which are not regarded as problems but which merited attention and/or a response,
appear to be on your 2002 construction calendar. I have received your submittal of technical revision TR-10 for the
backfilling of the 9360 adit. I will research the question of future charcoal packet needs, and contact you soon.
The revegetation of portions of the site, regardless of when they commence, will be an ongoing task for several
years. These additional issues do not carry a required date for their implementation or completion, and this office
will review your plans as they are submitted, monitor the projects as they are installed.
I look forwazd to working with you on these various projects and working toward the final reclamation of this site.
If you have questions or comments, I may be reached at the Division's Durango field office: 701 Camino del Rio,
Room 125, Durango, CO 81301; telephone 970/247-5193 or fax 970/247-5104.
Sincerely,
~~~.~
Bob Oswald
Environmental Protection Specialist
a:lbulldog pb extol/rco
