<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by DMG staff from the <br />DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO 81301, <br />phone 1970) 247-5469. Operations were active during the time of this inspection. <br />Tom Bird was not located and therefore not available to accompany the DMG <br />inspector. <br />Mine identification sign and safety signs were posted at the mine entrance. Permit <br />boundary markers were observed. Entrance gate was open. Timbers were stockpiled <br />inside the entrance gate. Debris was buying in the burn pit. Operations were active. <br />Construction of the new processing and loadout structure appeared near completion. <br />Affected area drainage was conveyed to one of the two sediment ponds for treatment. <br />Sediment containment ditches and culverts appeared to be well maintained and <br />functional. Minor ice accumulation was observed in some culverts. Materials for rock <br />gabion baskets were stockpiled near the upland diversion ditch. Mulch and erosion <br />control mats were in place on the face of the graded refuse disposal pile. Drainage <br />conveyance swale was intact for the entrance/haul road. <br />Large sediment pond was holding water approximately 2' depth. Primary and <br />secondary spillways appeared stable and clear of debris, debris screen was intact for <br />the primary spillway, no discharge noted. Pond embankment appeared stable. <br />Small sediment pond was holding water, approximately 1' depth, no discharge noted. <br />Primary and secondary spillways appeared stable and clear of debris. Embankment <br />appeared stable. <br />
