(Page 2) MINE ID # OR PROSPECTING ID # M-1997-064 INSPECTION DATE 1/15/07 INSPECTOR'S INITIALS RCO OBSERVATIONS This inspection was performed by the Division as part of its monitoring of Construction Materials 110c permits. The operator was contacted about the scheduled inspection, but was not present for it. The gate at the highway right-of-way fence was locked and access was gained on foot. The site was not active at the time of the inspection. There was a new snow cover of about 4 inches, which did not prevent inspection of the site. The required permit ID sign and permit boundary markers were observed posted. There were 2 ID signs: one by the highway right-of-wayfence and one near the NE entrance to the permit area. Mining activities have occurred onsite, and they appearto have been contained within the permit boundaries. There is evidence throughout the site that no mining or reclamation activity has occurred for several years. The site is on State Land Board land. A review of the file reveals that the operator's lease and right-of-entry were in question several years ago. The operator is reminded of 2 important items: (1) if legal right-of-entry is not maintained throughout the life of the operation, the operator may be in violation of the permit; and (2) if there is right-of-entry, and no more mining is planned, the operator has five years to complete reclamation of all mining disturbance. At this time, since there is no clear indication that there is right-of- lion date. (If the State Land Board wishes to provide information toward clarifying this situation it would be the problem correction is the operator's responsibility.) Onsite disturbance consists of clearing several acres of trees and brush, stripping the thin topsoil and piling it in the NE corner and W side of the permit, and shallow mining of the gypsum. Numerous small piles still remain scattered on the site. The level pad was created during mining by the removal of material on the north and some fill dozed to the south. A large vegetative buffer exists below the pad and disturbed area, and though much of the pad is bermed to control runoff, it is not clear if sediment may leave the site via a couple slots in the berm. This is not noted as a problem, but the operator should be aware of this possible need for improvement to the stormwater controls. There is no equipment or parts onsite, and no debris or contaminants. There are some annual weeds, but no noxious weeds. The bond posted ($20,600) is adequate to complete the required reclamation. No further items were observed during the inspection.
