III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The temporary diversion ditch at the east end of the mine bench disturbance area functioned property. The large <br />boulder just above the point of diversion at the upstream end has not yet been removed from the channel. The <br />boulder splits the flow coming down the channel, directing a portion of the flow directly toward the diversion <br />berm. It is recommended that the rock be moved to the far left side of the channel, to direct flow toward <br />the center of the channel. This will minimize the potential for a breach at the point of diversion, during future <br />high flow events. <br />Also, there are a couple areas of down-cutting along the upper steep segment of the diversion, and lower flat <br />segments of the diversion have substantially silted in. Riprap installation is recommended along the eroded <br />segments, and sediment accumulation should be cleaned out of the lower flat segment. <br />Backfiilinq and Gradin <br />There was no evidence of new erosion on the interim reclamation fill on the mine bench area, and and no <br />evidence of renewed cracking, caving, or sloughing. Areas of the fill which had been affected by caving on top <br />of the fill and surficial sloughage on the outslope have been properly graded, seeded, and mulched. <br />Processing Waste <br />Drainage structures associated with the waste disposal area have functioned well. Minor maintenance is <br />warranted to remove sediment deposition in some locations along the upper diversion above the cover <br />material stockpile, primarily along the middle segment of the ditch. Also, when the cover soil pile <br />grading and seeding is complete, the riprap segment of the diversion at the west end will need to be <br />restored across the temporary access road, down to the southeast corner of the sediment pond. <br />There was minor puddling at the west end of the initial disposal cell. Waste material within the cell has been <br />spread and graded, and the bottom of the cell is covered by a thin layer of graded refuse. <br />The three recently approved sediment disposal cells have been constructed on the top of the refuse area non- <br />toxic cover stockpile, and have largely been filled with sediment from two separate pond cleaning events. As <br />soon as the materials have dried sufficiently, the piles of dumped sediment and berms should be graded <br />out, ripped, and seeded. <br />Revegetation <br />Various small portal area disturbances have been seeded since the previous inspection. Various locations <br />disturbed in association with sediment clean-out and disposal, pond berm construction and spillway <br />modification in the vicinity of the refuse disposal area still need to be seeded with the interim seedmix. <br />4 <br />
