~.
III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Upstream from the upper coal pile, the road was within the channel for approximately 300 yards, then
exited on the right bank. From where the road exited the channel, a steep, cloddy, graded slope
extends for 50 yards or so, and then the reclaimed road runs along a gentle wooded bench for another
50 yards or more, before re-entering the channel. There was no seed evident along the +100 yard
graded section outside of the channel, and seeding appears to be necessary.
At the reclaimed drill pad area, silt fencing was down and dislodged, and fabric had pulled away from
stakes in several locations, on both sides of the channel. The silt fencing needs to be repaired.
The reclaimed slopes in the drill pad area have held up well, with essentially no erosion. There is some
recent germination of seeded species. Channel segments in the immediate vicinity of the drill pad did
experience some flow earlier this spring; the reclaimed channel segments functioned well with minimal
erosion.
4
