~. <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Upstream from the upper coal pile, the road was within the channel for approximately 300 yards, then <br />exited on the right bank. From where the road exited the channel, a steep, cloddy, graded slope <br />extends for 50 yards or so, and then the reclaimed road runs along a gentle wooded bench for another <br />50 yards or more, before re-entering the channel. There was no seed evident along the +100 yard <br />graded section outside of the channel, and seeding appears to be necessary. <br />At the reclaimed drill pad area, silt fencing was down and dislodged, and fabric had pulled away from <br />stakes in several locations, on both sides of the channel. The silt fencing needs to be repaired. <br />The reclaimed slopes in the drill pad area have held up well, with essentially no erosion. There is some <br />recent germination of seeded species. Channel segments in the immediate vicinity of the drill pad did <br />experience some flow earlier this spring; the reclaimed channel segments functioned well with minimal <br />erosion. <br />4 <br />
