III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. No one else was present during the inspection. The site was covered in 8 inches of snow. <br />Both entrance gates on County Road 53 were locked. <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds <br />Both ponds were frozen over. <br />Pond HG-8 was discharging an estimated 20 gpm of clear water. The pond's inslopes and <br />embankment appeared stable. Numerous tracks in the snow indicated the pond is being used by <br />wildlife where the pond is accessible outside the enclosure. <br />Pond 003 was discharging an estimated 5 gpm of clear water and its inslopes and embankment <br />appeared stable. <br />Springs and Seeps <br />RSP-3 and RSP-4 were frozen over but appeared to have trickles of flow beneath the ice. <br />SLIDES AND DAMAGE <br />As viewed from a distance through binoculars, the former highwall area showed no signs of slumping <br />outside the existing slump in the vicinity of the former south highwall. <br />-3- <br />
