A site inspection of Bestway Paving Company's Pit No. 1 was conducted in response to the operator's request. Present <br />during the inspection was Mr, Carl Hill and Mr. Gary Hill. <br />2. There has been virtually no change in the status of the affected land since the Division's last site inspection on <br />December 4, 2002, with the exception of a 0.2 acre pond which has now been backfilled to above the ambient <br />groundwater surface. Digital photographs of the site were taken and are attached to this report. The existing financial <br />warranty remains at $61,025. <br />3. A review of the permit file indicates that there are a total of 28.3 remaining permitted acres to be reclaimed. On March <br />24, 2003 the Division approved the operator's request for a partial financial warranty release via SR-3. (The operator had <br />supplied a revised Exhibit F -Reclamation Plan Map which specified the acreage to be released). <br />4. The operator discussed plans for the future development of Pit No. 1. Remaining affected land will be reclaimed as <br />part of "Best-Way Park". Under this plan, a majority of the site will be reclaimed to residential use. A smaller portion will <br />be reclaimed to industrial/commercial use. A series of hydraulic structures, including a stormwater holding pond, will be <br />installed by the City of Greeley. These structures, discussed in the previous 12/04/02 inspection report, Item #4 have not <br />yet been installed. The current reclamation plan specifies that a grass cover will be established after final grading. <br />However, the Division is willing to consider other methods for stabilization of these areas provided they are consistent <br />with the post-mining land use. <br />5. The operator expressed an interest in discerning what permitting changes, if any, may be necessary prior to achieving <br />a final financial warranty release. Based on the information provided by the operator, it appears that a technical revision <br />may be sufficient to accommodate all of the changes desired in the final reclamation plan for the remaining 28.3 acres of <br />affected land. However, the Division will make the final determination of whether the application will be considered as an <br />amendment or technical revision once the application is received.
