III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the CDMG. This coal operation <br />is currently under a temporary shutdown due to market conditions. Activities during the last 6 <br />months have been focused on major earth moving tasks and monitoring. No major <br />earthwork has been completed since last inspection. The weather was warm and ground <br />conditions were dry. Mr. Bobby Steele of Lorencito Coal Company was on-site on this day <br />but did not accompany me on the inspection. <br />Signs and Markers <br />The operator should place topsoil markers on the topsoil temporarily stockpiled on the <br />western boundary on the disturbed area. <br />Roads <br />The second culvert ascending the Jeff Canyon haul road should be cleaned at its inlet to <br />assist in proper function. As mentioned previously, a culvert is necessary on the Lorencito <br />Canyon haul road south of its intersection with the Jeff Canyon haul road. Diversion of flow <br />to the south to Jeff Canyon in the western road ditch has not been successful due to the <br />existing grade of the road. Instead, water flows to the north in this ditch and flows across the <br />road surface of the Lorencito Canyon haul road at the intersection. <br />Some repairs to the light-use road to pond 8 were noted. Time will tell if the diversion of <br />flows off this road into the adjacent arroyo is successful in stabilizing this area. <br />Hydrologic Balance <br />All ponds at the site held water but all water levels were well below the lowest discharge <br />point. The operator is in the process of establishing sediment markers as required by the <br />approved permit. Markers were observed in-place at pond 9 and pond 7. Excellent <br />vegetation was noted on the pond 6 embankment. Cleanout of ditch D96 will prevent future <br />problems during runoff events. <br />
