<br />III. Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />1. The mine water disc ha rye ditch has been lined with an old <br />conveyor belt. This action was taken in order to reduce the water <br />infiltrating into the mine bench fill. This approach was good for an <br />emergency solution. However, a more permanent remedy might be necessary. <br />2. The tension crack in the mine bench noted in the April <br />inspection report has extended to the south side of the crusher. <br />I4ovement along this slip plane has caused the base of the conveyor to <br />move. Water from the bench drainage ditch was infiltrating into the <br />tension cracks. <br />3. Uther slope stability problems were noticed in the following <br />locations. We observed a 15' wide circular failure from the toe of the <br />bench fill into the sediment pond. Also, a very large boulder had fallen <br />onto the haul road just south of the office. The upper diversion ditch <br />above the portals was not functional because of sloughage. <br />4. A portion of the topsoil stockpile had been moved in order to <br />repair the water intake pipe which serves the bathhouse. <br />5. The operator had used topsoil to repair the north embankment of <br />reservoir No. 1, adjacent to Hubbard Creek. This is in violation of <br />Rules 4.06.2 and 4.06.3. <br />
