Compliance with Colorado Surface Coal Mining Reclamation Act <br />CRS 1973, as amended 34-33-101, et. sue., <br />and the <br />R u1es and Regulations Issued Pursuant to the Act <br />This includes a listing of the particular provisions of the regulatory program which were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with the Rules and Regulations, the Act and <br />the permit. <br />4.02 Signs and Markers <br />The mine ID signs are in place and adequate; the perimeter of the area affected by <br />surface operations and facilities is not adequately marked. <br />4.03 Roads <br />Roads appear in good condition. <br />4.05 Hydrologic Balance <br />NPDES monitoring records OX; no pond discharge. Pond appears in good shape; non- <br />clogging orifice installed on 4" pvc dewatering device. Ditch and culvert at West <br />end of portal access road and ditch above and below scale house need maintenance. <br />Trout Creek had good f1 ow; inspected upstream monitoring points (surface and alluvial). <br />A downstream station is required...this will have to be negotiated with the Yortys <br />(neighbor). The question of use of a stream ford immediately upstream from mine <br />facilities perimeter was discussed: the only use has been to remove stockpiled <br />materials from the opposite bank. Several rolls of fence remain on the opposite <br />bank...operator must request permission to use stream ford prior to retrieving fence <br />materials. <br />
