_~ (Page 2) <br />MINE ID # OR PROSPECTING ID # M-1981-002 <br />INSPECTION DATE 10-26-2005 <br />OBSERVATIONS <br /> <br />INSPECTOR'S INITIALS SSS <br />This was a routine inspection conducted as part of the monitoring program for permitted mine sites in Colorado. The permittee <br />was notified of the inspection, but had a schedule conflict and was not able to attend. <br />The mine identification sign and affected area boundary markers are in place and in compliance with Rule 3.1.12. <br />A pile of processed recycled asphalt was located on site apparently used as product. Also, several piles of imported materials <br />have been dumped at the base of the highwall presumably to be used as permanent fill. Fill importation is in compliance with <br />their permit which was revised to allow importation of inert material for backfilling the highwall. No piles of excavated material <br />were noted, as mining activity at this site has been completed. <br />Noxious and/or problematic weed infestation (yellow toadflax and scentless chamomile) was observed within the affected area. <br />The infestation, if not controlled, will most likely hinder and/or delay successful reclamation of this site and contribute to off-site <br />spreading and establishment of these weeds. A weed control plan developed in consultation with, and approved by, the <br />appropriate local weed control authority must be submitted as a technical revision to this permit. Weed infestation is noted as a <br />problem, with the corrective action(s) and correction date specified on the last page of this report. Significant progress toward <br />control of on-site weeds must be demonstrated within three years to avoid potential Board action. A copy of this report will be <br />sent to the appropriate weed control authority for this area. <br />Sloughing of the highwall and it's progression toward the west permit boundary has been noted in several past inspection <br />reports. The permittee had indicated they would take measures to stabilize the highwall and revegetated it. Unfortunatelythis <br />was not accomplished in a timely manner and the highwall crest has now reached the permit boundary. One fence post of the <br />fence line that marks the western permit boundary is now hanging in mid-air. If the highwall erosion progresses anyfurther, the <br />operation maybe issued a violation for failure to protect off-site areas from damage, this matter maybe scheduled for hearing <br />before the Mined Land Reclamation Board. The permittee must now submit a plan of action to stabilize the highwall before <br />further erosion occurs. The plan must include timeframes for completion of the stabilizing measures in as short a time as <br />possible.
