III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on June 24 and June 25, 1998 by <br />Mike Boulay, David Berry, and Larry Routten of the DMG. Mike Altavilla of Seneca Coal <br />Company was present during the inspection. Weather conditions were warm and sunny. Ground <br />conditions were dry throughout the majority of the site. <br />Hydrologic Balance <br />At the road crossing for Armand Draw, please establish adequate drainage coming off of the fill <br />slope/pit ramp on the down gradient side of the road crossing. Stabilize the road embankment on <br />the down gradient side by utilizing sediment control and/or vegetation. Also please remove the <br />topsoil pile located in the Armand Draw drainage on the upgradient side of the road crossing. <br />It was noted that the riprap armoring may be piled to high in the emergency spillway for Pond <br />10. If appropriate, take measures to ensure proper functioning of the spillway. <br />Please clean culvert YB 1. At the time of the inspection, the outlet end of the culvert was <br />approximately three quarters of the way full of sediment. <br />Significant erosion is occurring at Pond 11. Rills and Gullies have formed at the head of the <br />pond. Please repair this azea by backfilling and regrading. It was also noted that the liner for the <br />emergency spillway needs to be keyed in, so that in the event of an emergency overflow, the <br />spillway would function as designed. <br />T soil <br />A small amount of topsoil may have been lost at the highwall end of the current pit. This amount <br />was balanced by soil recovered from an area previously designated for zero recovery. <br />At the very southern end of the stripped area for the pit excavation, it appeared that spoil material <br />may be slightly encroaching on unstripped ground. <br />Tab 21 of the Operations and Reclamation Plan specifica]ly states: <br />"To prevent unnecessary contamination and loss due to sloughing, soil shall be salvaged <br />a minimum of 5 to 15 feet from the edge of a road, end of pit, embankment, ditch, cut <br />slope, and toe of fill. Soil shall also be salvaged a minimum of 50 to 100 feet in advance <br />
