Inspection <br />Dear Mr. Eilu: <br />Enclosed please find a copy of the inspection report prepared by the Division for the April 14, <br />1992 inspection at the Meadows #1 Mine. During that inspection, you requested information <br />on a number of issues which were listed in the report.. Following are the results of the Division <br />inquiry regarding those issues. <br />1. In the matter of the cattle guard at the entrance to the mine, the settlement <br />agreement between yourself and Sun Coal Company, October 25, 1933 (Roust <br />County Civil Action #S1CV93) indicates that Sun Coal Company would provide <br />a cattle guard to be installed at your e.~tpense. The agreement states that Sun <br />Coal Company would determine the .appropriate dimensions and type of <br />construction for the cattle guard. The Division does not review cattle guard <br />designs and does not perceive the cattle guard currently in place at the mine <br />entrance to be a public safety hazard. <br />2. During the inspection you requested information on .the extent of the <br />responsibility of Sun Coal Company concerning disturbance created prior to the <br />current mining laws. Sun Coal Company is responsible for the reclamation of any <br />disturbance used in conjunction with its present mining permit (C-51-029), <br />regardless of the date of original disturbance. Those areas not havins been used <br />since the mine permit was issued would not be included in the liability of Sun <br />Coal Company. <br />In the matter concerning the haul road outslopes, the October 25, 1953 settlement <br />
