~. <br />(Page 3) <br />MINE ID / OR PROSPECTING ID / K-83-084 <br />INSPECTION DATE 12-26-95 INSPECTOR'S INITIALS GSC <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />PV-1 The active pit ie approximately 6 acres in size and 4-30-96 <br />concurrent backfillinq and reclamation were not being PB or PV PV <br />done pursuant to the approved mine plan. This may be a TOPIC(S) MP.RS <br />possible violation to the approved mining plan in that BG <br />the active pit has exceeded the maximum allowable size <br />of 2.1 acres. <br />Corrective Action: Either backfill the pit to the <br />approved maximum size of 2.1 acres or submit a complete <br />amendment to the permit. This needs to include revised <br />mining and reclamation plans and maps which increase <br />the maximum allowable pit size, provide plane for <br />reclaiming all areas disturbed by the mining operation <br />including the pits and settling ponds and recalculates <br />the financial warranty amount. The backfillinq activity <br />or amendment submittal must be completed no later than <br />April 30, 1996. During operations, the operator must <br />resume concurrent backfillinq and reclamation until the <br />approved mining and reclamation plane are changed and <br />approved by the Division. <br />PB-1 There are currently no design criteria for the sediment 4-30-96 <br />pond in the permit file. PB or PV PB <br />TOPIC(S) PW.TS <br />Corrective Action: The Office of the State Engineer has <br />determined this is not a jurisdictional dam. Operator <br />needs to determine if this an MSHA dam or if it falls <br />within the jurisdiction of the Division of Minerals and <br />Geology ae a tailings dam. If not an MSHA dam, the <br />operator will need to submit to the Division and get <br />approved, design parameters and construction <br />specifications for the structure and a demonstration of <br />stability both from a flood containment and a elope <br />stability standpoint. The design specifications must <br />be submitted and approved no later than April 30, 1996. <br />In any case, a reclamation plan needs to be submitted <br />by April 30, 1996 for the settling pond structure and <br />submitted as a revision to the permit. <br />PB-2 The pit and settling pond have been enlarged. 4-30-96 <br />PB or PV PB <br />Corrective Action: Submit a map showing all current TOPIC(S) MP, FN <br />disturbance. Include a calculation of the total <br />disturbance with a revised reclamation coat estimate. <br />If the operator will be submitting an amendment, this <br />needs to be included. <br />
