(Page 3) MINE ID / OR PROSPECTING ID / K-83-084 INSPECTION DATE 12-26-95 INSPECTOR'S INITIALS GSC The following problems (PB) and/or possible violations (PV) (and suggested corrective actions) were identified during this inspection. The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS CORRECTION DATE PV-1 The active pit ie approximately 6 acres in size and 4-30-96 concurrent backfillinq and reclamation were not being PB or PV PV done pursuant to the approved mine plan. This may be a TOPIC(S) MP.RS possible violation to the approved mining plan in that BG the active pit has exceeded the maximum allowable size of 2.1 acres. Corrective Action: Either backfill the pit to the approved maximum size of 2.1 acres or submit a complete amendment to the permit. This needs to include revised mining and reclamation plans and maps which increase the maximum allowable pit size, provide plane for reclaiming all areas disturbed by the mining operation including the pits and settling ponds and recalculates the financial warranty amount. The backfillinq activity or amendment submittal must be completed no later than April 30, 1996. During operations, the operator must resume concurrent backfillinq and reclamation until the approved mining and reclamation plane are changed and approved by the Division. PB-1 There are currently no design criteria for the sediment 4-30-96 pond in the permit file. PB or PV PB TOPIC(S) PW.TS Corrective Action: The Office of the State Engineer has determined this is not a jurisdictional dam. Operator needs to determine if this an MSHA dam or if it falls within the jurisdiction of the Division of Minerals and Geology ae a tailings dam. If not an MSHA dam, the operator will need to submit to the Division and get approved, design parameters and construction specifications for the structure and a demonstration of stability both from a flood containment and a elope stability standpoint. The design specifications must be submitted and approved no later than April 30, 1996. In any case, a reclamation plan needs to be submitted by April 30, 1996 for the settling pond structure and submitted as a revision to the permit. PB-2 The pit and settling pond have been enlarged. 4-30-96 PB or PV PB Corrective Action: Submit a map showing all current TOPIC(S) MP, FN disturbance. Include a calculation of the total disturbance with a revised reclamation coat estimate. If the operator will be submitting an amendment, this needs to be included.
