MINE ID # OR PROSPECTING ID #: M-~ 2995-ns <br />INSPECTION DATE: 2-»-f12 INSPECTOR'S INITIALS: -BLL <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site AT THE REQUEST OF THE OPEARTOR THAT IS <br />TRYING TO SUCCED THE SITE FROM EL PASO COUNTY. The site is a small 6 acre sand and gravel operation, <br />mostly stream deposit located approximately 2 miles South of Ramah Colorado, and operated by EI Paso <br />County. On 6-19-02, the Division received a Transfer of permit and succession of operation application, <br />waiving their right to a 30- day processing time for approving the application. The waiver was needed to <br />allow the Division to calculate the appropriate financial warranty based on the current and proposed future <br />disturbance. Mr Henry Schuller, the private operator who is trying to succeed the operation thought the <br />permit area was 9.9 acres and wanted the DMG representative to show him the permit boundary markers, <br />and explain to him what he would need to increase the permit area. <br />The Division prior to the site visit calculated the amount of warranty that will be needed for the present <br />disturbance so it will be presented during the site visit. The Division also brought along an amendment <br />application that will be needed to expand the permit area from its present 6 acres to 9.9 acres. <br />The Division walked and pointed out all four permit boundary markers to Mr. Schuller and discussed <br />possible ways he could expand the permit area, depending where the resources he wants to mine are <br />located. A brief discussion was also held on how to satisfy his storm water permit application, to CDOH&E. <br />He sated that he thought the permit area was 9.9 acres and with that in mind, he was going to submit a <br />warranty in the amount of $20,000.00. He was informed that the warranty is determined based on the <br />amount of acreage the operator wants to disturb and the approved reclamation plan, and provided him a <br />copy of the Division's warranty calculations based on the 6 acres that was permitted by the County. He was <br />also provided with a copy of an Amendment application form so he can submit it, to the Division with a <br />revised map ,and any changes to the mining and reclamation plans, he wants to implement. He stated that <br />all he wants is to add acreage to the permit area. All mining and reclamation plans are to remain as was <br />approved in the original permit. He agreed to have the area professionally surveyed and provide the <br />required maps with the Amendment application.
