<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />A copy of this file (report) has been provided to Clyde Sharp, Colorado Department of Public Health <br />and Environment. <br />Deep snow and unplowed roads restricted access to the site. Observations of this inspection were <br />accomplished from State Highway 131, Routt County Road (RCR) 179, and that section of RCR 29 <br />that parallels the west boundary of the permit area. <br />SIGNS AND MARKERS <br />The only signs and mazkers observed were mine identification signs at entrances to the facilities area in <br />the vicinity of Oak Creek off of State Highway 133 and RCR ] 79, and the North Haul Road. These <br />signs were in place and in good repair. <br />ROADS <br />Roads were covered with about two feet of snow, and piles of snow from plowing operations blocked <br />access. <br />HYDROLOGIC BALANCE <br />The area was covered by snow. No open water was, from a distance, observed on any of the <br />impoundments. The pond sites were not inspected due to snow cover on the access roads. <br />By chance, Byron G. Walker (Walker), of the Division of Minerals and Geology, met Chris Miller <br />(Miller), of Miller Water Monitoring, on site. Miller, and environmental contractor of the mine <br />operator, was preparing to take water samples (snowmobile access). As observed by both Miller and <br />Walker, the seep or spring reported in the previous inspection report is Spring SE-2 as shown on <br />Exhibit 1, Spring & Seep Locations, of the 2004 Annual Hydrological Report. The discharge from this <br />spring is collected in an irrigation ditch. Downstream, this ditch also collects the dischazge from the <br />West Ridge pond. The combined flows join discharge from the Center Ridge pond just above the <br />Colorado Discharge Permit System outfa11007 (the site of a flume). <br />BACKFILL AND GRADING <br />A small amount of grading is currently required at the facilities azea adjacent to Oak Creek to complete <br />the requirements of the reclamation plan.
