Also present during the inspection <br />were Jim Weldon and John Hamilton representing Denver Water. The site is roughly located west of "Old <br />Brighton Road" and approximately Y. mile south of 120~h Avenue in Adams County. The site is presently <br />bounded on the north by Suburban Sand and Gravel's Road Runners Rest II pit and on the west by the South <br />Platte River. <br />This inspection was performed to review operations being conducted to install a slurry wall around the <br />perimeter of the gravel pit. Denver Water is the permitted operator for this site as well as the landowner. The <br />site was acquired by Denver Water through condemnation proceedings with the intention of using it to <br />construct a storage reservoir in conjunction with two adjacent gravel pits once mining is completed. <br />The primary post-mining land use for this site, as well as the adjacent sites, is an unlined recreation reservoir. In <br />order for the site to be changed into a storage reservoir an amendment to the permit application would be <br />required. By installing a slurry wall around the site, the operator is conducting an un-permitted activity in <br />potential violation of their reclamation permit. As a result of conducting these un-permitted activities the office <br />will be issuing a reason to believe letter that a possible violation exists for failure to follow the approved <br />reclamation plan and for failure to minimize disturbances to the hydrologic balance. Corrective actions will be <br />to submit an amendment to the permit application proposing a change to the post-mining land use along with <br />a technical evaluation of the potential disturbances to the prevailing hydrologic balance as a result of <br />installing the slurry wall. Both of the possible violations and the corrective actions are included on page three <br />of this report. <br />A third possible violation that is also being included with this inspection report, is mining without a permit for <br />disturbances just northeast of and adjacent to this site. Approximately 5-10 acres of disturbance had occurred <br />in this area including the excavation of a large pond and the construction of a smaller pond within this area to <br />use in preparing the slurry mix for installation into the perimeter slurry trench. Also ground preparations for slurry <br />wall construction had occurred. Since this disturbance is outside of any permitted area, it may be considered <br />mining without a permit in violation of C.R.S. 34-32.5-109(1). Corrective actions will be to amend this area into <br />one of the existing Denver Water permitted sites or to file an application for a new application for the <br />disturbance outside of existing permitted areas. <br />Since Envirocon, Inc. is the contractor performing the work on this site they are also being issued a Reason to <br />Believe Letter for a possible violation for mining without a permit.
