The $300 filing fee has been received and given <br /> receipt no. 10042356. <br /> The initial date of approval for this SWSP was April 29, 2020 under Plan ID 6103 for operation <br /> beginning May 1, 2020. Pursuant to section 37-92-308(4)(b), "If an applicant requests <br /> renewal of a plan that would extend the plan past five years from the initial date of <br /> approval, the applicant shall demonstrate to the water judge in the applicable water <br /> division that the delay in obtaining a decree has been justifiable and that not being able to <br /> continue operating under a substitute water supply plan until a decree is entered will cause <br /> undue hardship to the applicant... Approval of a plan pursuant to subsection (5) of this <br /> section shall be deemed to be approval under this subsection (4) for the purposes of <br /> calculating the number of years from the initial date of approval." The Motion was filed in <br /> the Division 2 Water Court on April 29, 2025, and granted on May 12, 2025. <br /> SWSP Operation <br /> The Box Creek Placer Mine is a gold placer operation operated by Titan Au, Inc. The location <br /> is along the eastern valley of the Sawatch Range, approximately 8.5 miles south-southwest <br /> of Leadville, Colorado. Corske Creek enters the site from the southwest corner, and during <br /> low flows, terminates within the central portions of the 950-acre permit area. Box Creek <br /> enters from the northwest, and terminates in the northern central most portion of the site. <br /> The operation will excavate and process a placer gold deposit. A schematic of the process is <br /> attached to illustrate the water uses. The gold-bearing gravel is located approximately 20 <br /> feet above the existing clay layer. The overburden will be excavated and placed in <br /> previously mined areas for reclamation. Gold-bearing gravel will be processed for the gold <br /> and the washed gravel will also be replaced into mined out excavations. The operation will <br /> mine all the way to the clay bed, and expose groundwater as the existing groundwater table <br /> is approximately three feet below the surface. <br />
