13. Taxes. Lessor shall pay, if applicable, all real property taxes levied and assessed against <br /> the Leased Premises during the term of this Lease, and the Lessee shall pay all additional taxes <br /> assessed against the Leased Premises, imposed because of or relating to the processing, <br /> stockpiling, removal, transporting, and sale of Materials, and Lessee shall pay all personal <br /> property taxes levied and assessed against the Lessee's personal property located on the Leased <br /> Premises during the term of this Lease. As between Lessor and Lessee, Lessee shall be <br /> responsible for the payment of any and all sales, use and/or severance taxes related to the <br /> severance,sale or use of Materials removed from the Leased Premises. <br /> 14. Exemption for Sales and Use Taxes. As provide in 39-26-205(3) Colorado Revised <br /> Statutes, as amended from time to time, the Leased Premises and all other improvements made <br /> to, or installed on, the Leased Premises that are owned by the Lessor (whether constructed by, <br /> for or at the expense of Lessor or Lessee), shall be exempt from any lien for sales and use taxes <br /> owed by Lessee otherwise imposed by the taxing authorities of the State of Colorado. In order to <br /> secure this exemption from the date of execution of this Lease, upon execution of this Lease, <br /> Lessor shall execute and Lessee shall prepare,execute and file a Memorandum of this Lease with <br /> the Colorado Department of Revenue. <br /> 15. Utilities. Lessee shall contract in its own name and pay for all charges for electricity, <br /> gas, fuel, telephone, trash hauling and any other services or utilities used in, servicing, or <br /> assessed against the Leased Premises, unless otherwise herein expressly provided. Unless <br /> otherwise set forth herein, Lessor makes no representation or warranty as to, and shall have no <br /> responsibility or liability in connection with, the current or future availability of any utilities to <br /> the Leased Premises. At termination of the Lease, any utility lines and facilities installed by or <br /> on behalf of Lessee shall become Lessor's property, at no cost to Lessor, to the extent that <br /> Lessee does not remove any such facilities within sixty days after termination of this Lease. <br /> 16. Title. Lessor makes no representations or warranties as to the title to,the condition of, or <br /> the suitability for use by Lessee of the Leased Premises. <br /> 17. Compliance with Laws. Lessee's operations on the Leased Premises shall be in <br /> accordance with good and accepted industry practices and in compliance with all federal, state <br /> and local laws, rules and regulations. The Lessee shall remain individually responsible for <br /> compliance with all environmental rules,permits, and reclamation requirements. <br /> 18. Lessee's Indemnification.
