EXHIBIT D <br /> Mining Plan <br /> Mininq Limits <br /> Northern Colorado Constructors, Inc. (NCC) proposes to mine in the amended land located in <br /> the parcel of land situated in the east 1/2 of Section 24, Township 2 North, Range 67 West of <br /> the 6,h Principal Meridian, in Weld County, Colorado. <br /> The proposed mining site is located within the City of Fort Lupton. CR 25 is east of the property <br /> and an access road from the property connects to CR 25 approximately 3,200 feet north of the <br /> intersection of CR 25 and CR 18. A portion of the property is adjacent to CR 18 to the south. <br /> The South Platte River is approximately 2,000 feet to the northeast of the property. The <br /> dominant land use surrounding the property is agricultural use (west and east), water storage <br /> reservoir use (north and south), and sand/gravel mining properties (north and south). <br /> The permit boundary will encompass approximately 124.25 acres which will all be affected <br /> acreage, and approximately 33.08 acres being mined. The remaining area will consist of access <br /> roads, and disturbed/undisturbed land. All setbacks specified in the surface use agreements with the <br /> oil/gas companies will be followed. The final executed agreements are expected to be obtained <br /> in the near future and will be forwarded to the Division when they are available. A minimum 200- <br /> foot setback from any existing oil/gas facility will be maintained until that time. See Exhibit C, <br /> Mining Plan Map, and the Slope Stability Report for the mining limit configuration and <br /> information on setbacks and their locations. The abandoned wells would be cutoff after mining <br /> has reached the bedrock surface or the reclaimed slope surface where a new cap and any <br /> additional concrete for the existing plug would be needed. Occidental Petroleum (Oxy) is the <br /> leaseholder and operator of the existing abandoned wells. We have also worked with Peterson <br /> Energy Operating, Inc. to provide this service at other mining permit locations for other <br /> operators. If Oxy does not want to perform this work, then Peterson Energy Operating, Inc. <br /> would be contacted to do it. They are licensed and bonded to obtain approvals from the <br /> Colorado Energy and Carbon Management Commission (ECMC) to do these types of re-plug <br /> services on abandoned oil and gas wells. <br /> Northern Colorado Constructors.
