The surface and mineral ownership is private and federal.By memo dated January <br /> 23,2026,the Bureau of Land Management,Little Snake Field Office provided its concurrence with DRMS's <br /> proposed decision. OSM interprets this to mean Seneca Property LLC(SPL)is in compliance with all stipulations <br /> associated with its federal coal leases. <br /> DRMS's proposed decision notes SPL's compliance with the approved Colorado regulatory program at Rules <br /> 3.03.1(2)(a-c)and recommends Phase I release on 8.50 acres,Phase II release on 17.04 acres, and Phase III <br /> release on 215.25 acres. DRMS currently holds a performance bond in the amount of$737,413.00 which covers <br /> the entire permit area including the acreage proposed for release.Under SL-9 DRMS proposes to release all of the <br /> $737,413.00 from Phase I,II, and III bond liability.
