Additionally, the County stated that no Standard <br /> Grading and Erosion Control Permit was approved with this project, in contradiction of what was submitted on <br /> Item 15 in the "Is It Mining?" questionnaire. The email correspondence from the County the Division is <br /> included as Attachment C. <br /> On October 15, 2025, the County issued a Notice of Zoning Violation #ZVI-2025-00113 for"Earth/Sand <br /> Extraction activities" for material that is being transported to a construction company and is compensating the <br /> Operator on a per-load basis under a contractual agreement. Arapaho County Notice of Zoning Violation#ZVI- <br /> 20205-00113 has been included as Attachment D. <br /> As stated in DRMS' Determination letter to the operator's submitted "Is It Mining?" questionnaire, any <br /> significant deviation from the described activity could result in the review and possible reversal of this <br /> determination. Based on the new information provided from the County, including haulage fee compensation <br /> (Attachment E), as well as activities observed by DRMS during their inspection, DRMS has determined that a <br /> Mining Reclamation permit is required for the activities that have occurred at 56505 East County Road 26, <br /> Strasburg. <br /> Division's Site Observations on October 20, 2025: <br /> The operator was not contacted for this site visit. DRMS made all the following observations from East County <br /> Road 26 and did not enter the property. <br /> The entrance road to the site is an existing road that was observed during the July 21 inspection (photo 1). <br /> The road is constructed of crushed stone less than 1/2 inch in diameter. At the far northern end of the road <br /> are 2 shipping containers that were on site during the July inspection. The entrance road is still in place and <br /> appears to be the only entrance to the site; however, the entrance gate has been removed, and some bigger <br /> white stone has been added as road base. The Division's July 21 inspection report is provided as Attachment F. <br /> An excavator was parked on the site. It appears that all sand extraction disturbances on the site has taken <br /> place on the west side of the property between the entrance road and the western property boundary. Using <br /> the landmarks noted on-site,the sand extraction disturbance was measured in Google Earth to be <br /> approximately 11.5 acres (photo 2/map). The disturbance is setback from both the western property <br /> boundary and the county road about 20 feet. No other disturbances were seen elsewhere on the property. <br /> The eastern edge of the excavated area appears to be approximately 1 foot deep (photo 5). The depth of the <br /> excavated area on the western edge appears to be deeper, ranging from 2-5 feet deep (photo 6). <br /> Photo 7, which was provided to the Division as part of the citizen complaint originally received August 18th, <br /> documents earth/sand being excavated and loaded to be hauled offsite. <br /> Topsoil has been salvaged and is staged around the perimeter of the disturbed area in long piles ranging in <br /> height from 5-8 feet. <br /> Page 3 of 14 <br />
