December 19, 2025 <br /> Ms. Amy Yeldell RECEIVED <br /> Environmental Protection Specialist III <br /> Colorado Division of Reclamation, Mining, and Safety nrf; 2 2 2025 <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 DIVISIONOFREC1AWMON <br /> MINING AND SAFETY <br /> Subject: Response to October Ore Pile Reclamation, Permit M-2008-050, Incomplete <br /> Application for Transfer of Mineral Permit and Succession of Operators, <br /> Revision SO-1 <br /> Dear Ms. Yeldell: <br /> AURA GRIT LLC (AURA GRIT) is in receipt of the Colorado Division of Reclamation, Mining, <br /> and Safety (DRMS) letter dated December 17, 2025, that discusses missing items from <br /> our Application for Transfer of Mineral Permit and Succession of Operators. This letter <br /> provides responses to the individual items discussed in DRMS' letter, and certain <br /> missing information is attached, herein. <br /> 1. No application fee was submitted. Please provide the Hard Rock SO fee of $115. <br /> Response. The application fee is attached to this letter. The original of this letter, <br /> along with fee, are being sent to Ms. Sara Stevenson-Benn, DRMS. <br /> 2. Provide the Division copies of agreements to compensate the owners of any <br /> significant, valuable, and permanent man-made structures and utilities within 200 <br /> feet of the affected land ("Structure Agreements"), Rule 6.3.12. See attached from. <br /> If none, include a statement of such. <br /> Response. AURA GRIT knows of no such structures within 200 feet of the affected <br /> land that require compensation. The only man-made structure that exists is the <br /> Sweat Lodge adjacent to the October Pile, which is on Federal land. This <br /> structure is a historic resource that is being protected and is not under the <br /> ownership of Nuvemco, LLC. <br /> 3. Prospective Permittee is signed by Stephen Cohen however the notary is for Grayson <br /> Buckingham therefore the notary is invalid. Please resubmit a valid performance <br /> warranty. <br />
