<br /> <br /> <br /> <br /> <br /> <br />December 22, 2025 <br /> <br /> <br />Joel Konig <br />Konig Ag Co. <br />37231 Hwy. 14 <br />Briggsdale, CO 80611 <br /> <br /> <br />Re: Konig Borrow Pit - File No. M-2010-055 <br /> Konig Ag Co. <br /> Surety Release Request (SL-1) <br /> Request for Full/Final Release <br /> <br />Dear Joel Konig: <br /> <br />On December 22, 2025 the Division of Reclamation, Mining and Safety concluded its review of the <br />Surety Release Request application submitted to the Division on November 10, 2025, addressing the <br />following: <br /> <br />The Operator has requested a release of the entire permit area. <br /> <br />The decision reached by the Division is: Approve. <br /> <br />I am pleased to inform you that the Division of Reclamation Mining and Safety has determined that <br />Konig Ag Co. is eligible for release from further responsibility for the Konig Borrow Pit. In <br />accordance with Rule 4.17.2(5), the Division is required to wait thirty (30) days from this notice to <br />allow for appeal of the Division’s decision.
