EXHIBIT H WILDLIFE INFORMATION(CONT) <br /> Threatened and Endangered Species and Critical Habitat <br /> There are no threatened or endangered species on the permit <br /> area to our knowledge. The site contains no habitat suitable for <br /> the Preble 's meadow jumping mouse. Areas near the seasonal irri- <br /> gation ditches within the site have steep sides and do not have <br /> vegetative cover that is characteristic of Preble' s habitat . <br /> Bald Eagles have been removed from the Threatened and Endangered <br /> list however they still fall under the Migratory Bird act . As <br /> noted above, there is an active nest west of the South Platte <br /> River more than one-half mile west-northwest of the permit area <br /> and mining will not take place close to this area. <br /> Proiect ff ects to Wildlife <br /> Existing wildlife in the area is not expected to be signifi- <br /> cantly impacted by mining at this site. The property lies in the <br /> Mule Deer Winter Range along the east side of the South Platte <br /> River. Temporary and permanent losses of winter range or food <br /> and habitat are not expected to be significant as the area of <br /> disturbance will be limited to less than 30% of the permit area <br /> at any given time. Haul road speed limits will be limited to 15 <br /> MPH or less within the mine. There may be some displacement of <br /> smaller birds and mammals during active mining operations in a <br /> phase, but once reclamation is complete wildlife uses should re- <br /> turn to pre-mining activity levels . <br /> 8 1/2 Enterprises LLC.
