Please respond to this Notice of Filing Deficiencies 2 with <br />the requested information and summarize each response to the numbered items below, in a cover letter titled <br />“Response to Notice of Filing Deficiencies 2 CN1, M-2023-015”. <br /> <br />EXHIBIT N – Source of Legal Right to Enter (Rule 6.4.14) <br /> <br />7. Within the response to Item #4, the Applicant/Operator states one unpatented mining claim is a part of the <br />affected lands and provided an Amended Certificate of Location of the MineWastePile Placer Mining Claim <br />within Exhibit N. To demonstrate subsurface legal right to enter, please provide documentation from the Bureau <br />of Land Management demonstrating the MineWastePile is a valid and active unpatented mining claim. To <br />demonstrate the surface legal right to enter, please provide an approved or conditionally Mine Plan of <br />Operations from the United States Forest Service (USFS). <br /> <br />8. The maps presented in Exhibit N show parcels within the proposed affected lands (pink) and other parcels <br />controlled by MineWater (green). Around several parcels, especially in the northern portion of the proposed <br />affected area, there is a different-shaded pink outside of the parcel boundary. Please discuss these areas and <br />either provide additional legal right to enter documentation and parcel number labels or revise the map <br />accordingly. <br /> <br />9. Among the cluster of parcels associated with the southeastern proposed permit area, there is a small triangle- <br />shaped parcel that is different-shaded pink. The Park County Assessor Map Viewer shows the owner of this <br />parcel is USFS. Please provide documentation similar to the requirements of Item #7 above or revise the permit <br />acreage and maps accordingly. <br /> <br />10. The southern portion of the proposed permitted area contains one large parcel which has two parcel numbers <br />labeled. The Park County Assessor Map Viewer shows there are four parcel numbers within this large single <br />parcel. Please explain how R0091202 (Holiday Exploration Company) and R0091199 (Western States Minerals <br />LLC) relate to R0091201 and R0091200 (both MineWater Finance LLC) and provide applicable documentation <br />to comply with Rule 6.4.14 <br /> <br />11. The southeastern proposed permit area includes several parcels that are identified on the Exhibit N Table as <br />being owned by MW Sorter LLC while the Park County Assessor Map Viewer shows the owner as MW HH <br />LLC. Please explain this discrepancy and revise the table accordingly. <br />
