Peter Foster and Jonah Howe, Wright Water Engineers Page 13 of 14 <br /> Re: Gunnison West Gravel Pit SWSP, Amendment No. 1 <br /> December 12, 2025 <br /> letter dated April 30, 2013 that dedicates 3.125 cfs of the Applicant's 4.33 cfs in <br /> the Seventy-Five Ditch water as replacement water for out-of-priority depletions <br /> solely for this SWSP. This replacement water must remain dedicated to this site <br /> as long as there are depletions at this gravel pit site or until such time as <br /> another replacement source is obtained. For the purposes of this SWSP, this <br /> letter will be accepted for the dedication of the shares; however, if the State <br /> Engineer determines that a different affidavit or dedication process is necessary <br /> to assure proper dedication of the shares, additional information may be <br /> required prior to future SWSP approvals. Additionally, a bond has been obtained <br /> for $292,970 through DRMS for reclamation at this site. <br /> 15.The State Engineer may revoke this SWSP or add additional restrictions to its <br /> operation if at any time the State Engineer determines that injury to other <br /> vested water rights has or will occur as a result of this SWSP. Should this SWSP <br /> expire without renewal or be revoked prior to adjudication of a permanent plan <br /> for augmentation, all use of water at the pit must cease immediately. <br /> 16.Any substituted water shall be of a quality and continuity to meet the <br /> requirements of use to which the senior appropriation receiving the substitute <br /> supply has normally been put. <br /> 17.The decision of the State Engineer shall have no precedential or evidentiary <br /> force, shall not create any presumptions, shift the burden of proof, or serve as <br /> defense in any Water Court case or any other legal action that may be initiated <br /> concerning the SWSP. This decision shall not bind the State Engineer to act in a <br /> similar manner in any other applications involving other plans or in any proposed <br /> renewal of this SWSP, and shall not imply concurrence with any findings of fact <br /> or conclusions of law contained herein, or with the engineering methodologies <br /> used by this applicant. <br />
