Approval of this SWSP is for the purposes as stated herein. Additional wells <br /> and/or additional uses for the water that is the subject of this SWSP will be <br /> allowed only if a new or amended SWSP is approved for those additional <br /> wells/uses. <br /> 4. The water consumption and depletions associated with this mining operation <br /> must not exceed those amounts described above and on attached Table 3. <br /> Documentation of the exposed groundwater surface area may be required by the <br /> Division Engineer in the form of an aerial photo evaluation or survey by a <br /> Professional Land Surveyor during the plan year or in subsequent years covered <br /> by renewals of this SWSP. <br /> 5. The replacement water that is the subject of this SWSP cannot be sold or leased to <br /> any other entity. As a condition of subsequent renewals of this SWSP, the <br /> replacement water must be appurtenant to this site until a plan for augmentation is <br /> obtained. This SWSP does not allow for offsite water deliveries. <br /> 6. The Applicant must replace all out-of-priority depletions in time, location, and <br /> amount resulting from operation under this SWSP, including those lagged depletions <br /> that occur to the stream after the expiration date of this SWSP. <br /> 7. The Applicant shall maintain daily records of all diversions, replacement, and the <br /> amount of water used for each particular purpose. The Applicant shall provide a <br /> report of these records to Division Engineer Bob Hurford (Bob.HurfordCstate.co.us) <br /> and Water Commissioner Jack Brazinsky (P.O. Box 456, Montrose, CO, 81402, <br /> telephone 970-964-7947, Jack.BrazinskyCstate.co.us). The accounting must be <br /> submitted within ten (10) calendar days of the end of the month for which the <br /> accounting is being made during times of stream administration. The Applicant shall <br /> also provide an annual report to the Division Engineer and the Water Commissioner by <br /> November 15th, which summarizes diversions and replacements made pursuant to this <br /> SWSP. Accounting forms are subject to modification and approval by the Division <br />
