Peter Foster and Jonah Howe, Wright Water Engineers Page 10 of 14
Re: Gunnison West Gravel Pit SWSP
December 8, 2025
10.All pumping for dust control shall be measured in a manner acceptable to the Division
Engineer.
11.The approval of this SWSP does not relieve the Applicant and/or the landowner of
the requirement to obtain a Water Court decree approving a permanent plan for
augmentation or mitigation to ensure the permanent replacement of all depletions,
including long-term evaporation losses and lagged depletions after gravel mining
operations have ceased. If reclamation of the mine site will produce a permanent
water surface exposing groundwater to evaporation, at least three (3) years prior to
the completion of the mine an application for a plan for augmentation must be
filed with the Division 4 Water Court, to include, but not be limited to, long-term
evaporation losses and lagged depletions. If a lined pond results after reclamation,
replacement of lagged depletions from mining and dewatering shall continue until
there is no longer an effect on stream flow.
12. Dewatering at this site will produce delayed depletions to the stream system. As long
as the pit is continuously dewatered, the water returned to the stream system should
be adequate to offset the depletions attributable to the dewatering operation. If
dewatering at the site ceases, the depletions (including a first fill or intermittent fill)
must be accounted for and out-of-priority depletions must be replaced. At least
three (3) years prior to completion of dewatering, a plan must be submitted that
specifies how the post pumping dewatering depletions (including refilling of the pits)
will be replaced in time, location, and amount.
13.The Applicant shall provide written notification to the Water Commissioner and
Division Engineer by May 1, 2026 identifying the lands to be dried up for the 2026
irrigation season, and by May 1, 2027, identifying the lands to be dried up for the
2027 irrigation season. The Applicant shall perform inspections and provide
verification that the land associated with the changed water right in this SWSP has
been removed from irrigation during the term of this SWSR Final verification of
dry-up must be in the form of an affidavit signed by an individual with personal
