If a renewal request is received after the <br /> expiration of this SWSP, it may be considered a request for a new SWSP, in which <br /> case the $1,593 filing fee will apply. <br /> 2. For all well(s) included in this SWSP, the Applicant shall ensure that all well <br /> permit file(s) are complete and valid and the uses proposed for the well(s) in <br /> this SWSP are consistent with the decreed and permitted uses. If well permit(s) <br /> for any of the well(s) do not meet this standard, the permit file(s) must be <br /> completed or valid well permits must be obtained prior to expiration of this <br /> SWSP. Should the uses and amounts under this SWSP exceed permitted uses and <br /> amounts, new permit(s) must be obtained in accordance with section <br /> 37-90-137(2), C.R.S. and this SWSP. The provisions of section 37-90-137(2) <br /> prohibit the issuance of a permit for a well to be located within 600 feet of any <br /> existing well, unless the State Engineer finds that circumstances so warrant after <br /> a hearing in accordance with the procedural rules in 2 CCR 402-5. The hearing <br /> will be waived if the Applicant is able to obtain statements from the owners of <br /> all wells within 600 feet, verifying that they have no objection to the use of the <br /> proposed well. <br /> 3. Approval of this SWSP is for the purposes as stated herein. Additional wells <br /> and/or additional uses for the water that is the subject of this SWSP will be <br /> allowed only if a new or amended SWSP is approved for those additional <br /> wells/uses. <br /> 4. The water consumption and depletions associated with this mining operation <br /> must not exceed those amounts described above and on attached Table 3. <br /> Documentation of the exposed groundwater surface area may be required by the <br /> Division Engineer in the form of an aerial photo evaluation or survey by a <br /> Professional Land Surveyor during the plan year or in subsequent years covered <br />
