• July 2020 DE—ROO I—I 9LM70256 <br /> APPENDIX C <br /> SPECIFIC REQUIREMENTS AND STIPULATIONS <br /> The Lessee agrees to comply with all applicable statutes and regulations,including but not limited to the following <br /> items: <br /> (a) Prior to resuming mine-development or extraction operations that were previously approved by DOE <br /> and permitted by the Colorado Division of Reclamation,Mining and Safety(DRMS)on the Property,the Lessee <br /> shall notify the LM ULP Program Manager in writing prior to resuming such operations.In addition,the Lessee <br /> shall provide DOE with an environmental analysis that includes changes,additions,or modifications to the original <br /> plan that are now proposed and that accurately analyzes the environmental impacts associated with the resumption <br /> of activities. Upon receipt of such notification,the LM ULP Program Manager shall review the original plan,along <br /> with any new information provided by the Lessee.and determine if additional stipulations are warranted.When all <br /> applicable requirements are satisfied,DOE shall provide the Lessee with a written approval to proceed. <br /> (b) All existing serviceable improvements not associated with the Lessee's operation,such as fences,gates, <br /> 1111 cattle guards,roads,trails.culverts,pipelines,bridges,and water development and control structures that arc <br /> authorized for use by the Lessee,shall be maintained in serviceable condition by the Lessee.Such improvements(if <br /> not owned by the Lessee)which are damaged or destroyed by the Lessee's operations shall be replaced,restored,or <br /> paid for by the Lessee,with evidence of payment to DOE. <br /> (c) The Lessee's operations shall not disturb public land survey corner markers or monuments or <br /> U.S.Atomic Energy Commission survey markers without the prior written approval of the LM ULP Program <br /> Manager.Additionally,the Lessee shall pay all costs associated with the surveys required to preserve or reestablish <br /> the true point of any such marker or monument and the replacement of such marker or monument. <br /> (d) Housing and other buildings and support facilities related to community development constructed or <br /> located on the Property may be allowed only upon the prior written approval of the LM UI.P Program Manager. In <br /> constructing and locating such housing,other buildings,and support facilities,the Lessee shall comply with <br /> applicable county planning and zoning regulations,subdivision regulations,mobile home regulations,this Lease, <br /> any permits requirements,any applicable laws and regulations and land use restrictions,and shall furnish written <br /> evidence of such compliance to the LM ULP Program Manager upon request. <br /> • <br /> —Cl- <br />
